TERMS AND CONDITIONS OF SALE (TCS)

2. Scope of Application
These TCS govern the sale of figurines and works of art (the “Products”) carried out on the website www.napstoria.com, to consumers as defined by the French Consumer Code. Any order implies full and unconditional acceptance of these TCS.
3. Product Information
Descriptions, dimensions, materials (e.g. polyurethane resin), finishes, limited editions and certificates of authenticity are specified on each product page. Photos are for illustration purposes only; colors/tones may vary depending on screens and artisanal processes. Safety/use: unless otherwise stated, these are art/collectible objects, not toys, not intended for children.
4. Prices, Taxes, and Fees
Prices are indicated in euros. VAT “VAT not applicable – Article 293 B of the CGI.” Displayed prices do not include delivery, reinforced packaging, or transport insurance fees, which are calculated and displayed before checkout.
International sales: unless otherwise stated, shipments outside the EU are made DAP/DDU (Delivered at Place): import duties and taxes (customs, local VAT, clearance/advance fees) are payable by the customer and usually collected by the carrier upon delivery. DDP (prepaid taxes) option available upon quotation.
5. Order (Double‑Click / Obligation to Pay)
Process: Cart → Identification/Address → Delivery/Payment selection → Summary → “Order with obligation to pay” button (confirming the order after verification). An acknowledgment is sent by e‑mail.
6. Contract Archiving ≥ €120
For any online order of €120 (VAT incl.) or more, the contract is archived for 10 years and available upon customer request (copy by e‑mail or client account).
7. Payment
Accepted methods: [CB/Stripe], [PayPal], [bank transfer], [others]. Payment is debited upon order, except for custom orders: deposit [X%] at order, balance before shipment. Payments are secured by our service providers; we do not store your banking data.
8. Delivery, Deadlines & Transfer of Risk
Indicative delivery times are indicated on the product page or in the cart. Otherwise, delivery occurs within 30 days after order confirmation.
– Seller’s carrier: risk is transferred upon delivery to the client.
– Customer‑chosen carrier (if applicable): risk is transferred upon delivery to the carrier.
Serviced zones, “signature upon delivery” options, and transport insurance are recommended for valuable artworks. In case of damaged parcels, issue detailed reservations immediately with the carrier and notify us within 48 hours.
9. Right of Withdrawal (Distance Selling)
You have 14 days from receipt to withdraw without giving reason.
– Legal exceptions: no withdrawal for clearly personalized or made‑to‑order products (e.g. custom orders, engraving, specific patina), nor for unsealed security seals guaranteeing artwork integrity.
– Return: within 14 days of notification, in original (or equivalent) packaging, complete and in perfect condition. Return costs are at your expense (except defect or our error).
– Refund: within 14 days from notification of withdrawal, which may be deferred until receipt or proof of shipment. A withdrawal form is provided below.
10. Legal Warranties
Legal warranty of conformity (2 years): repair/replacement or, failing that, price reduction or contract cancellation. All related costs are covered by us.
Hidden defects warranty (art. 1641 Civil Code): you may choose contract cancellation or price reduction. Any commercial warranty is indicated on the product page.

12. Consumer Mediation

13. Retention of Title
Products remain our property until full payment is received. Transfer of risk occurs as described in article 8 above.
14. Intellectual Property
All works, images, texts, and logos on the site are protected. Any unauthorized reproduction or use is prohibited.

16. Applicable Law — Disputes
French law applies. The consumer may bring any dispute before the competent courts as per ordinary law. Prior amicable resolution and/or mediation is encouraged.
